1. Acceptance of Terms

By creating an account or using the Service in any way, you confirm that you are at least 13 years old and have the legal capacity to enter into this agreement. If you are using whspr on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

whspr is an anonymous messaging platform that allows users to receive anonymous messages, questions, and feedback from others via a unique shareable link. The Service includes profile management, message inbox, custom link aliases, and email notifications.

3. Your Account

You are responsible for maintaining the security of your account credentials. You must not share your password or allow others to access your account. You are responsible for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep that information up to date. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Acceptable Use

You agree not to use whspr to:

• Send, transmit, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Send spam, chain letters, or unsolicited commercial communications
• Harvest, scrape, or collect user data from the Service
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Use the Service to engage in cyberbullying, stalking, or any form of harassment
• Distribute malware, viruses, or any code designed to disrupt or damage the Service
• Violate any applicable local, national, or international law or regulation

5. Content

Your Content: You retain ownership of any content you submit to whspr. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, and display that content solely to provide the Service.

Anonymous Messages: We do not claim ownership of anonymous messages sent to you. You acknowledge that anonymous messages may contain opinions or views that whspr does not endorse.

Content Removal: We reserve the right (but have no obligation) to remove content that we determine in our sole discretion violates these Terms or is otherwise objectionable.

6. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The whspr name, logo, design, and all associated intellectual property are owned by whspr and protected by applicable intellectual property laws. You may not use any of our intellectual property without our express written permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We are not responsible for the content of anonymous messages sent by third parties. Use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, whspr and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) USD $10.

10. Termination

You may stop using the Service at any time and may request deletion of your account by contacting us. We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate business reason.

11. Changes to Terms

We may revise these Terms from time to time. We will provide reasonable notice of material changes, such as updating the "Last updated" date. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
